Yes they did.  And horses were still stolen, just by different people.

Mmmmm... okay.  

So is the conclusion that punishment is never a deterrant?  Cuz I don't buy that.  I strongly suspect fewer horses were stolen than would otherwise have been stolen based on the deterrent element, not JUST on the fact that dead people can't steal horses.
 
And I don't buy that our current system is working (specifically on car theft here) well enough.  

And I don't buy that a system strictly based on 'rehabilitation' constitutes justice either.

I think that properly measured consequences can act as a deterrant, and that the current consequences are inadequate.  Other solutions haven't worked here, acknowledging that not all others have been thought of or tried.

i.e. - a balance can be found and what we have not is not balanced.
